NEW DELHI: The Madras high Court has upheld the postal ballot facility extended by Election Commission to absentee voters including persons above 80 years of age, persons with disabilities, essential services staff and Covid-19 patients/suspects, terming it as an ‘inclusive’ measure introduced by the poll panel in exercise of its plenary powers under Article 324 of the Constitution.
In its ruling on the plea challenging legality of the Section 60 (c) of the Representation of the People Act, 1951 and the corresponding rules extending postal ballot facility to these absentee voters, the high court said “it must be acknowledged that all that the Election Commission has done here is to be inclusive and allow certain classes of persons who would have been excluded from exercising their franchise the right to use the postal ballot and participate in the celebration of the festival of democracy”.
It added that if the process was made inclusive without compromising on secrecy of the ballot or fairness of elections, “it would be a greater cause to celebrate and compliment the conducting body.”
The Court did not find any arbitrariness in the classification of the persons committed by the Rules of 1961 to cast their vote by postal ballot. It held that the consideration appears to have been as to who may not be able to physically attend a polling booth to cast her vote.
The Court said the petitioner’s contention that EC has no jurisdiction to issue guidelines, has to be discarded in the light of the plenary authority conferred on such Commission by Article 324 of the Constitution. Further, the Supreme Court has in the past recognised the authority of EC to pass any orders in respect of the conduct of elections when there is no parliamentary legislation or rule made under the said legislation.
Commission had launched postal ballot option for 80-plus citizens. disabled voters and those engaged in essential services in Jharkhand elections of 2019. In Bihar polls last year, EC further extended this facility to those who had tested positive for Covid-19 or were suspected to be Covid-positive.

Observing that a person facing sexual harassment charges must be suspended first before proceeding with an inquiry, the Madras High Court on Friday wondered why a Special Director General of Police (now on compulsory wait) accused of having made sexual advances towards a woman Superintendent of Police had not been suspended yet in order to inspire confidence in the criminal investigation as well as an internal inquiry initiated against him.

Justice N. Anand Venkatesh raised the query during the hearing of a suo motu writ petition taken up by him to monitor the investigation in a criminal case booked against the ex-Special DGP as well as a Superintendent of Police, who reportedly waylaid the victim when she was on her way to lodge a complaint and forced her to talk to the prime suspect over phone, as well as an inquiry being conducted by the Internal Complaints Committee (ICC) into the charge of sexual harassment.

“Wouldn’t you have immediately resorted to suspension if a similar charge had been levelled against an inspector of police or sub- inspector? What is the hesitation in suspending this person? Is he so great that you will not suspend him? Suspension is what you should have done first?” the judge asked.

Making it clear that he was not questioning the police for not having arrested the Special DGP as well as the SP so far since arrest was completely the prerogative of the investigating officer concerned and courts could not force the police to arrest the suspects in any criminal case, the judge said suspension was squarely a different matter altogether since one could not expect a fair probe when even bare minimum action had not been taken against the prime suspect.

Tamil Nadu Class 9, 10 and 11 students to be promoted without exam

Tamil Nadu CM Edappadi K Palaniswami Wednesday announced that all class 9, SSLC (class 10) and class 11 students to be promoted without the exam. The government took the decision based on the inputs from medical experts who suggested the situation is not conducive to conduct the SSLC and plus one exam.

The students will be assessed based on their marks on the internal assessment. The marks for the pending exam will be divided into two parameters. As much as, 80 per cent of marks will be evaluated based on students’ performance in quarterly and half-yearly examinations and 20 per cent will be based on attendance.
